Mercer Independence - Pension Plan Policy Grievance
(Policy GR# 0862)

WUFA alleges that the University used the plan actuary, Mercer Canada, in ways that compromised the plan actuary’s required independence under the text of the pension plan agreement.

In August 2016, Arbitrator Picher determined that Mercer Canada should be replaced as the Plan's Actuary. The University then filed for Judicial Review of the arbitrator's ruling.

Status Update: The Judicial Review was postponed in order to consider the Intervenor Status request by Mercer. No dates have been set for the intervenor motion or judicial review.

Failure to investigate 'Conflict of Interest' allegation
(Policy GR# 0909)

The University was informed of the Association’s concerns regarding a perceived conflict of interest in the case of a member of the Board of Governor’s Investment Committee. This grievance alleges that the University has failed to investigate the allegations properly or in a timely manner or taken any effective steps to remove the conflicted person/companies.

Bargaining Unit Membership
(Policy GR# 0929)

The University has created a number of position in various categories across campus in which WUFA’s bargaining unit work, as defined in the Collective Agreement and through past practice, has been and/or is being performed by individuals who are not members of the bargaining unit.

Status Update: The arbitration hearing is scheduled to resume on November 20 & Dec 12, 2019 and Feb 5 & 6, 2020, with arbitrator Kelly Waddingham.

Deans’ Reports in Student Complaint Cases
(Policy GR# 0962)

WUFA is aware of at least two (2) student complaint cases in which the accused members were not provided an opportunity to view or respond to the Deans’ reports before they were submitted to the Provost and President. In each case the Provost and/or President issued a letter of censure to the member based on the Dean’s report.

Failure to Post Courses as Required under Article 54:07 and Article 5:07
(Policy GR# 0972)

On at least two occassions known to WUFA, the University has assigned courses to full-time members to be compensated with an overload stipend, without first posting the courses as required under Article 54:07 and 5:07 of the Collective Agreement.

Former Administrators on Admin Leave, excluded from the Bargaining Unit
(Policy GR# 0977)

It came to WUFA's attention that former administrators on leave from their faculty positions are not being returned to the bargaining unit during the term of their administrative leave.

Failure to Remit Dues

The University has failed to remit dues for a member who is a former academic administrator on admin leave.

Vacant Sessional Lecturer Positions, Article 55:11

The University has refused to initiate the process to fill vacancies in Sessional Lecturer positions as required under Article 55.

Failure to Provide a Harassment Free Workplace
(Policy/Group GR# 0908)

The University has failed to provide a safe and free from harassment workplace for its employees generally, and for the group of employees hereby listed as all members in the Department of Political Science who have been and/or maybe affected by the facts and allegations set out in the written grievance.

Status Update: On June 27, 2019 the Policy/Group grievance was delivered to the University. Beginning in Fall 2019, the grievance will be discussed at Step 3 between the WUFA President and the Executive Director, Academic & Staff Labour and Employee Relations.
