GR# 1059 - Violation of Article 53 Validity

Nature of Dispute: On November 29, 2022, Ontario Bill 124, Protecting a Sustainable Public Sector for Future Generations Act (2019) was struck and deemed unconstitional. The Bill was ultimately repealed on February 22, 2024. WUFA requested that the parties renegotiate all articles of the Collective Agreement impacted by the demise of Bill 124. The employer refused to renegotiate all of the articles that WUFA asserted were affected by Bill 124.
Result of Grievance: Arbitrator Andrew Tremayne upheld the grievance, confirming that Articles A, J, N, P, R, and T should be renegotiated in good faith and directing the parties to return to the bargaining table. For more information, read the Arbitrator's Award and reasons below.
